These Terms and Conditions (the “Terms and Conditions”) prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry and claim instructions are deemed to form part of these Terms and Conditions and by participating all participants will be deemed to have accepted and be bound by them. Participants should retain a copy for their information.

 

The Promoter takes data protection seriously. By entering this promotion, participants confirm that they have read the Privacy Policy and agree to these Terms and Conditions of the promotion. By submitting any information required as part of their participation in the promotion, participants agree to their information being held and processed in accordance with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.

1. The promotion is open to residents of the UK (England, Scotland, Wales, and Northern Ireland), aged 18 or over only, excluding employees and their immediate families of Nestlé UK Ltd, their agents or anyone else professionally connected with this promotion.

 

2. Entrants must be aged 18 or over and have access to the internet, a smart phone or device with QR code reading capability if using the QR code to access the promotion, and a valid, current email account.

 

3. The promotion opens at 00:01 on 11.09.24 and closes at 23:59 on 10.01.25.

 

4. Any entries received outside these dates will not be included in the prize draw.

 

5. A maximum of one prize per person/household can be won across total promotional period. Entrants will be required to provide their full name and a valid email address. The Promoter reserves the right, at its sole discretion, to disqualify any individual found to be attempting to circumvent this clause by tampering with the operation of the promotion, using alternative details, setting up multiple accounts or using multiple identities, or otherwise acting in a manner deemed by the Promoter to be in violation of the Terms and Conditions. Bulk entries made from trade, consumer groups, agents, third parties or syndicates will not be accepted.

 

6. Smart phone (if using the QR code to access the promotion), internet access and a purchase/till receipt required. Participants are required to purchase any three (3) qualifying STARBUCKS® AT HOME products (Nestlé products only) from Morrisons, Co-op, Waitrose, Sainsbury’s or Ocado (online or instore) in a single transaction to enter. Purchases must be made between 11.09.24 and 23:59 on 10.01.25. 

 

7. To participate in the Promotion, the participant must, during the Promotion Period:

   a. Click on a link or scan a QR code.

   b. Select WhatsApp or SMS to receive an application form.

   c. Buy any three (3) participating STARBUCKS AT HOME products made by Nestlé (see Clause 9 for a full list of participating products) and keep a copy of the till receipt clearly showing their purchase made during the qualifying dates.

   d. Fill in the necessary fields on the form including first name, last name, county, and valid email address.

 

8. Participants must retain their valid till receipt as this will be required as part of the winner verification process. A valid till receipt or copy of online order must show the purchase of any three (3) STARBUCKS AT HOME products purchased in a single transaction during the stated promotion period. The Promoter reserves the right to refuse any till receipts that:

   • Are out of focus/blurry;

   • Do not have the correct product clearly visible;

   • Are old, out of date or fall outside of the stated promotional period;

   • That show store locations in geographical locations outside the stated promotional area;

   • Are not unique to the individual.

The Promoter reserves the right at its sole discretion to disqualify any individual found to be tampering with or altering till receipts. Any attempts to submit any invalid till receipts may result in the participant’s application being frozen and possibly deleted.

10. The first valid entry drawn at random from all entries received by the stated closing date will be deemed the top prize winner and will be awarded the prize of a trip for two (2) to Milan for 3 nights and 4 days. The prize includes travel, accommodation at a *4-star hotel, daily breakfast, £250 spending money and a VIP Tour of the Starbucks® Reserve™ Milano Roastery.

   • Five 2nd prize winners will each be awarded a Starbucks® at Home Hamper with NESCAFÉ Dolce Gusto® Machine. 

   • Five 3rd prize winners will each be awarded a £50 Starbucks Gift Card

 

11. The prize draw will take place on 21.01.25. The winners will be drawn at random via an independent third party from all valid entries received within the stated promotional period.

 

12. The Promoter will send an email to the winners (using the email address submitted upon entry) within 10 days of the draw date. The email will notify the winner that they have won, confirm their prize, and give details of next steps to arrange delivery of their prize. 

 

Prize Details

 

13. The first prize winner will be awarded the trip for two to Milan for 3 nights and 4 days. The prize includes travel, accommodation at a *4-star hotel, daily breakfast, £250 spending money and a VIP Tour of the Starbucks® ReserveTM Milano Roastery. The prize is as indicated, and any additional costs incurred in taking up the prize will be the sole responsibility of the winner and their guest which must be settled directly with the relevant vendors. Due to the nature of the prize, the winner and their guest must be 18 or over, except where the winner is the parent or legal guardian of an accompanying minor. The Promoter’s travel agent will make arrangements directly with the winner. The trip must be booked by no later than 30.04.25 and all travel completed by 30.01.26. All travel and accommodation will be subject to availability and some blackout dates may apply including, but not limited to, Christmas, New Year, Easter and Bank Holidays/Festival dates. Winners should give at least six weeks’ notice in advance of their chosen travel dates. The winner and their guest will be responsible for ensuring they have all/any necessary travel documents/visas necessary to undertake the trip.  

   • Five 2nd prize winners will receive a Starbucks® at Home Hamper with NESCAFE Dolce Gusto® Machine.

   • Five 3rd prize winners will receive a £50 Starbucks Gift Card.

 

14. The prize items will be dispatched to the winner by Signed For post within 14 days of verification, and confirmation of a suitable address where the items can be signed for by the winner or a designated person. 

 

15. The Promoter accepts no responsibility for failed delivery due to provision of incorrect contact details by entrants. Any prize that is returned undelivered will be assumed unwanted and the Promoter reserves the right to select an alternative winner to receive the prize using the same process referred to above in these Terms and Conditions. 

 

16. Whilst all reasonable steps will be taken to contact the winners, if this cannot be achieved within 14 days of the prize draw date, and after three (3) attempts, the Promoter reserves the right to cancel the prize entitlement and award the prize to a reserve winner who will be drawn at the same time as the original winner. If the reserve winner does not respond within 14 days of being notified, the prize entitlement will be withdrawn, and the prize removed from the promotion.  Participants are encouraged to check their emails, including their Junk and Span folders in case they are a winner. The Promoter is not responsible for late claims where the prize has been withdrawn and awarded to a reserve winner.

 

17. The Promoter reserves the right to verify all entries including but not limited to asking for receipt/proof of purchase, promotional packs/proof of packaging, address and identity details in the form of a copy of a current passport or driver’s licence (which they must provide within seven (7) calendar days) and to refuse to award a prize or withdraw prize entitlement, and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions or any instructions forming part of this promotion’s entry requirements or otherwise, where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The Promoter will be the final arbiter for all decisions, which are final and binding. 

 

18. Incomplete, illegible, corrupted entries, or those which are otherwise not in accordance with these Terms and Conditions will not be valid. The Promoter accepts no responsibility for failure to receive an entry where such failure is due to circumstances outside the Promoter’s control.

 

19. The Promoter cannot be responsible for entries that fail to register, are delayed or incomplete, or indeed for network, computer hardware or software failures of any kind, which may restrict or delay entry.

 

20. To the fullest extent permitted by law, the Promoter is not responsible for loss or damage to participants', or to any other person's, computer related to or resulting from participating in the Promotion or downloading materials from or use of the Site. Should any portion of the Promotion be, in the Promoter's sole opinion, compromised by virus, worms, bugs, non-authorised human intervention, technical failures or other highly exceptional circumstances which, in the sole opinion of the Promoter, corrupt or impair the administration, security, fairness or proper play, or submission of entries, the Promoter reserves the right at its sole discretion to suspend, modify or terminate the Promotion, and select the winners at random from all entries received prior to action taken or as otherwise deemed fair and appropriate by the Promoter.

 

21. In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the awarding of prizes, and only where circumstances make this unavoidable, the Promoter reserves the right to cancel or amend the promotion or these Terms and Conditions, at any stage, but will always endeavour to minimize the effect to participants in order to avoid undue disappointment.

 

22. The Promoter is not responsible for any costs or expenses (such as internet connection, travel) incurred in taking part in the promotion. The full cost of participation in the promotion is borne by the participant.

 

23. Prizes are non-transferable and cannot be sold or auctioned. No cash or other alternative to a prize will be offered save for in the event of unforeseen circumstances, in which the Promoter reserves the right to offer an alternative prize of equal or greater value than the original.

 

24. The Promoter and its agents will only use personal information supplied by entrants to this promotion for the purposes of administering this promotion unless consent is received to use such information for any other purpose. 

 

25. Limitations of liability: Neither the Promoter, its agents or anyone professionally connected to the Promotion, assume any responsibility or liability for:

   a. Any incorrect or inaccurate code entry, or for any faulty or failed electronic data transmissions.

   b. Any unauthorised access to, or theft, destruction, or alteration of data at any point in the operation of this Promotion.  Communications line failure, regardless of cause, with regards to any equipment, systems, networks, lines, satellites, servers, computers, or providers utilised in any aspect of this Promotion.

   c. Inaccessibility or unavailability of the internet or the website or any combination thereof.

   d. Regretfully, we cannot be held liable for system failures on the website.

 

26. The Promoter and / or third parties to whom it has called in the context of the promotion are not responsible for faults and / or faults on / in or relating to the Internet, the promotion page or any website mentioned in these regulations, cable networks (or other relevant network), software or hardware as well as for any possible incorrect entry and / or processing of personal data.

 

27. In the event that this Promotion is advertised on Facebook, Instagram or other external channels, it is specifically pointed out that this Promotion is in no way sponsored, approved or administered by, or associated with, Facebook, Instagram or these other external channels, which are not responsible for this.

 

28. Participants are not permitted to: (i) resell or use this Promotion or its contents for commercial purposes; (ii) collect and use any product listings, descriptions, or prices; (iii) download or copy information for the benefit of another merchant; (iv) use data mining, screen scraping, or similar data-gathering and extraction tools; (v) modify the paper or digital copies of any materials you have printed off or downloaded in any way, nor (vi) use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

 

29. In the event of circumstances outside the Promoter’s reasonable control and only where circumstances make this unavoidable, the Promoter and those partnered with the promotion reserve the right to cancel or amend the promotion or these Terms and Conditions at any stage but will endeavour to minimise the effect to participants to avoid undue disappointment.

 

30. If there is any reason to believe that there has been a breach of these Terms and Conditions, or of the spirit of this promotion, the Promoter may at its sole discretion refuse to accept an entry. 

 

31. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this promotion or accepting or using the prizes, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law.

 

32. By taking part in the promotion, the winners agree that the Promoter may contact them to ask whether they want to participate in marketing activities/PR relating to this promotion only. Such publicity may include, without limitation, the entrant’s name and/or if consent given, image or statements made by entrants concerning the promotion and/or prize obtained as part of the promotion. The winners are not obliged to agree to any such requests.

 

33. Subject to Nestlé’s Privacy Policy which can be found at https://www.nescafe.com/gb/nestle-privacy-notice the surname, county of residence and details of prize of the verified prize winners will be available upon request by sending an email to consumer.services@uk.nestle.com with the subject line ‘WINNERS LIST: STARBUCKS AT HOME MILAN GENERIC PRIZE DRAW’, for a period of three (3) months following the end of the main promotion. We reserve the right to refuse any or all such requests. When contacting this email address, your request will be actioned in line with Nestlé’s Privacy Policy. At the point of personal data collection for verification, all winners will be given the option to opt-in to having their surname, county, and prize type used for marketing purposes. If any winner subsequently objects to their information being published or used for marketing purposes, then they can contact the Promoter by emailing UKI.dataprotection@uk.nestle.com with the subject line: ‘WINNERS LIST: STARBUCKS AT HOME GENERIC MILAN PRIZE DRAW’. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. 

 

34. Data Protection: The Promoter will only use the personal details supplied for the administration of the promotion and the auditing of the applications where necessary and for no other purpose, unless we have your consent, and you have opted-in to receive future marketing communications. As part of this promotion, if you are not opted-in into our general marketing email, you may still receive emails for this promotion only regarding your refund.  Your personal details will always be kept confidential, and in accordance with the General Data Protection Regulation (GDPR). Where Hashting UK Ltd is not responsible for the delivery of the prizes, they shall share Winners’ personal information with the Promoter’s agent who is responsible for the delivery of the prizes.

 

36. If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

 

37. The Promotion and these Terms and Conditions will be governed by the laws of the participating country and any disputes as to the meaning of these Terms and Conditions will be subject to the exclusive jurisdiction of the participants’ local courts.
